Abstract

The Austrian Supreme Administrative Court held that the application for international protection lodged in another Member State by a Dublin returnee who already received a final negative decision in Austria (take back case in accordance with Article 18 (1)d)) is “automatically” taken over by the Austrian authorities and needs to be processed upon arrival in Austria. The applicant does not need to explicitly make an application again.
