This page presents asylum appeals systems in all EU+ countries for the regular and other types of asylum procedures. It includes a detailed overview of competent authorities (appeal bodies, courts and tribunals) and procedures in appeals lodged against a decision on international protection at the first appeal level the second appeal level and at cassation or other appeal levels, when applicable.

 

The information was reviewed by members of the EUAA Information and Analysis Advisory Group (national asylum authorities) and the EUAA Courts and Tribunals Network (judges and members of courts and tribunals).

 

The following structure is followed for each EU+ country:

 

  • Competent authorities: Information on the competent authorities which examine the appeal, nature of the body (judicial/non-judicial), composition of the panel examining the appeal and information about the panel members/judges.

  • Access to the appeal procedure: Information on the availability of the appeal, digitalisation and suspensive effect of an appeal.

​​​​​​​

  • Time limits on appeal: Information on time limits to lodge an appeal and to decide on the appeal in the regular asylum procedure.

  • Parties on appeal: Information on the parties involved in an asylum appeal (the first instance authority and others) and the rights of the applicant, including information provision, interpretation and legal assistance and representation.

  • Procedure and outcome: Information on the scope of the appeal (merits and legality aspects), procedural steps and organisation of hearings, decision/judgment and the applicant’s access to it, case management tools and any other aspects.

  • Other appeals: Information on appeals in other types of procedures presented in the same format as for the regular procedure. The procedures include: admissibility, accelerated, border procedure, subsequent application procedure, Dublin procedure, appeals against detention measures, appeals concerning reception conditions, family reunification, appeals against revocation/withdrawal of international protection, appeals concerning temporary protection, and appeals against a return following a negative asylum decision.
