Abstract

The applicant, a Sudanese national of Zaghawa ethnicity and from North Darfur, requested international protection in France due to an alleged fear of persecution in case of return to Sudan on the basis of his ethnic origin and imputed political opinions. On 29 December 2016, the OFPRA rejected the request. On appeal, the CNDA provided refugee protection.


The court noted several classified decisions establishing the authoritarianism of the Khartoum regime and the well-founded fears of people in Sudan who express anti-government opinions or are imputed such opinions by the authorities, in particular on an ethnic basis. The court made a geopolitical analysis of the persecutions suffered by the members of this community in Darfur since 2003.
