Abstract

The case concerned applicants from Syria whose asylum applications were not considered by the State Secretary because they have applied in Denmark. The Council of State considered, based on the conclusions on a similar case decided on the same day (Applicants v State Secretary for Justice and Security (Staatssecretaris van Justitie en Veiligheid), 6 July 2022) that there is a real risk of indirect refoulement, in violation of Article 3 of the ECHR and Article 4 of the EU Charter upon transfer to Denmark because of the protection policy for Syrian applicants there.
