Abstract

The case concerned a Somalian national who entered Austria and was sent back to Slovenia, without being provided access to the asylum procedure. The Regional Administrative Court of Styria has found that the person concerned had used the word “asylum” in “English language” several times in the course of their official act towards Austrian security forces after crossing the border and thus concluded that the applicant had de facto protection against deportation in accordance with Section 12(1) of the Asylum Act of 2005. Thus, the applicant should not have been rejected under Section 41 Aliens Police Act. The Supreme Administrative Court rejected a revision request by the Styrian Provincial Police Headquarters and cited a previous case concerning a Moroccan applicant (Styrian Provincial Police Headquarters, Ra 2021/21/0274, ECLI:AT:VWGH:2022:RA2021210274.L00, 5 May 2022).
