Abstract

The applicant, a national of Mali from the region of Kayes, requested subsidiary protection in Italy or to be allowed to remain in Italy under humanitarian protection. The request was denied by the administrative authorities and the Perugia Tribunal.


Upon appeal before the Court of Appeal of Perugia, the request was allowed and the applicant was provided with subsidiary protection. The court made reference to the CJEU judgment of Diakite. It noted that the in-depth analysis on the current geo-political situation in Mali carried out through the consultation of specialized sites outline a picture of a country affected by a situation of armed conflict or generalized violence. The court held that the analysis of the most recent and updated information sources fully confirms the existence, also in the region of origin of the applicant, Kayes, in Mali, of a picture of overall destabilization that is progressively extending to the whole country.
