Abstract

The applicant expressed his wish to apply for international protection on 4 November 2021 and requested material reception conditions from Fedasil by e-mail on 5 November 2021. The tribunal noted that when physical access to the arrival centre is not possible, the authority should organise its processes to be able to reply to such requests from distance within a reasonable time limit. The tribunal also underlined that there were no circumstances, that Fedasil could evoke to exclude the applicant from material reception conditions. Thus, it ordered Fedasil to accommodate immediately the applicant under the penalty of 100 euro per day for any delay.
