Abstract

The Council of State ruled that the State Secretary should carry out a reassessement of the designation of safe country of origin for Mongolia. The present case concerned an LGBTI+ applicant from Mongolia. 


"In the reassessment the State Secretary must consult the sources of information as specified in Article 37(3) of the revised APD Directive or he should explain why this is not possible. The reassessment can be done on the basis of the eight criteria, which the state secretary uses, namely: 'democratic governance', 'protection of the right to freedom and security of the person', 'freedom of expression', 'freedom of religion and association', 'protection against discrimination and prosecution by third parties, ‘access to independent investigations,’ ‘access to an independent judiciary,’ and ‘access to legal remedies.’"
