Abstract

The applicant, an Uzbek and Tajik national, requested international protection in Czechia on 30 September 2020, after he was arrested following a vehicle check when it was found that he was the subject of an arrest warrant in Uzbekistan. The Ministry of the Interior rejected the request by decision of 30 May 2023. The applicant contested this decision first by appeal before the Municipal Court of Prague and subsequently by cassation complaint before the Supreme Administrative Court.


The Supreme Administrative Court referred to the CJEU case of Torubarov v Immigration and Asylum Office (C-556/17, 29 July 2019), in which the court ruled that judicial courts have the power to overturn administrative decision in the granting of international protection.
